Petitioner seeks Anticipatory bail in connection with Naokothi P.S. Case No. 99 of 2017 registered under Section 30(a) of Bihar Prohibition and Excise Act.

Allegation is recovery of 1347.84 liters of wine from the vehicles.

It has been submitted on behalf of petitioner that petitioner is not named in the FIR. His name has surfaced in course of investigation merely on the basis of suspicion and nothing has been recovered from his possession. It has been further submitted that similarly placed co-accused persons have

Considering the facts and circumstances of the case, prayer of Anticipatory bail is allowed and petitioner named above in the event of arrest or surrender before the court below within four weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge IInd cum Special Judge, Excise Act, Begusarai, in connection with Naokothi P.S. Case No. 99 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
