The petitioner has filed the instant application for grant of regular bail in connection with Akbarpur P.S. Case No. 197 of 2022 registered under Section 392 of the Indian Penal Code.
Prosecution case relates to commission of robbery by two miscreants and snatched key of the motorcycle and bag containing some cash and other belongings of the informant. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He has falsely been implicated in this present case. It is further submitted that on the basis of confessional statement of coaccused, the name of the petitioner came into light in this case. A statement has been made in para 3 of the petition that

As per the seizure list which is annexed with this petition, one Samsung Tab and one Key pad mobile has been recovered from the house of the co-accused Ranjit Kumar and not from the possession of the petitioner. Similarly situated co-accused persons have already been granted bail by this co-ordinate Bench of this Court vide 09.12.2022 and 07.12.2022. in Cr. Misc. No. 50512 of 2022 and 44443 of 2022 respectively. Petitioner is languishing in judicial custody since 17.05.2022.
The application for bail is vehemently opposed by learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Akbarpur P.S. Case No. 197 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, 1st, Nawada.
