JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Bakhari P.S. Case No. 69 of 2019 registered for the offences punishable under Sections 341, 328, 302, 120B and 376D/34 of the Indian Penal Code.

As per FIR petitioner has illicit relationship with the deceased and he has taken her to his house and later on the informant was informed that her condition is serious and she died later on.

Submission of learned counsel for the petitioner is that petitioner has love affair with the deceased and he was taking care of the deceased but deceased has committed suicide and she was taken to the Doctor but she died, the above facts will also appear from the materials collected during investigation.

Patna High Court CR. MISC. No.54050 of 2019(4) dt.18-10-2019 2/2 Heard learned APP, who has opposed the prayer for anticipatory bail on the ground that proclamation has already been made under Section 82 Cr.P.C.

In view of above facts and circumstances, let petitioner surrender within a period of three weeks from the receipt of this order and pray for regular bail, which shall be considered on the basis of materials available in the case diary and, if possible, to be disposed of on the same day.
