This is a petition for grant of regular bail in connection with Rivilganj P.S. Case No. 17 of 2018 for offences under Sections 25(1-B)A, 26 and 35 of the Arms Act. The accusation against the petitioner is that one country made pistol with five live cartridges were recovered from his possession while they had assembled in the cow shed of Umesh Kumar Yadav and making plan to commit crime. Learned counsel for the petitioner submits that the recovery of the arms is shown from the possession of the petitioner but it was recovered from the cow shed and other coaccused apprehended there along with the petitioner, have been
Patna High Court Cr.Misc. No.47582 of 2018(2) dt.03-08-2018 2/2 admitted to bail by coordinate Benches of this Court and this petitioner has remained in custody for last six months and above.
Having considered the aforesaid facts and circumstances, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Rivilganj P.S. Case No. 17 of 2018. to the satisfaction of the Additional Chief Judicial Magistrate, Saran at Chapra on the conditions that one of the bailors must be close family member of the petitioner and secondly, the petitioner shall appear on each and every date before the trial Court and in case of absence on two consecutive dates without any reasonable cause the bail bond shall be liable to be cancelled by the trial Court.
