JUSTICE PURNENDU SINGH ORAL ORDER 06-04-2023 Heard Mr. Tribhuwan Narayan, learned counsel appearing on behalf of the petitioner and Mr. Shailendra Kumar, learned APP appearing on behalf of the State.

2. The petitioner apprehends his arrest in connection with Complaint Case No. 130 of 2022 registered under Sections 498(A), 406, 323, 379 of the Indian Penal Code.

3. Learned counsel appearing on behalf of the petitioner submitted that petitioner is ready to keep his wife and he is concern about his four children. It has been informed that marriage took place 18 years back and the children are now living along with the petitioner.

Patna High Court CR. MISC. No.51803 of 2022(3) dt.06-04-2023 2/2 Opposite Party No. 2 has informed that Opposite Party No. 2 is ready to live and accompany petitioner wherever he works.

5. Considering the willingness of the parties who are husband and wife, the Court below is directed to release the petitioner on anticipatory bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate-I, Kaimur, Bhabua in connection with Complaint Case No. 130 of 2022, subject to the condition as laid down under Section 438(2) of the Cr.P.C.

6. This order will automatically loose its force if the Opposite Party No. 2 makes any serious allegation of harassing or demand of dowry against the petitioner.
