The petitioner, who is in custody, seeks bail in connection with Navanagar (Sonvarsha) P.S. Case No. 68 of 2018 registered for the offence punishable under Section 392, 412 of the Indian Penal Code.
Informant has alleged in FIR that on 02.05.2018 at about 11 AM he stayed in a hotel and about 3.00 AM in the morning he and Amerika Yadav proceeded with Bolero Pickup van and after one KM one Bolero Jeep overtook his vehicle and thereafter his vehicle was taken away by one of the miscreants and Rs. 7000/- and mobile was snatched from the informant and Amerika Yadav, on such allegation he lodged the present
Patna High Court Cr.Misc. No.46824 of 2018(2) dt.08-08-2018 2/2 FIR against four unknown persons.
It has been submitted that petitioner is innocent and has been falsely implicated in this case. He has no criminal antecedent and one similarly situated person Bharat Sharma has already been granted bail in Cr. Misc. No. 45276 of 2018 dated 27.07.2018. The name of petitioner has transpired in this case on the basis of confession of one co-accused and except that confession there is no other incriminating material against the petitioner. It has been further submitted that petitioner is in custody since 07.06.2018.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Buxar, in connection with Navanagar (Sonvarsha) P.S. Case No. 68 of 2018.
