====================================================== CORAM: HONOURABLE MR. JUSTICE KHATIM REZA ORAL ORDER 11-08-2025 Heard learned counsel for the petitioner, learned A.P.P for the State and learned counsel for the informant.
2. The petitioner seeks bail in connection with Sursand P.S. Case No. 586 of 2024 dated 15.12.2024 registered for the offence punishable under Sections 137(2), 96 and 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. The allegation against the petitioner is of kidnapping informant's minor daughter with the help of coaccused persons.
4. Learned Counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. It is submitted that the petitioner is the father of
2/4 the main accused Raja Mandal. It is submitted that earlier a case was lodged by the same informant against the petitioner and others under same sets of allegation vide Sursand P.S. Case No. 371 of 2024 for kidnapping of the present victim but the police submitted final form in the aforesaid case. It is submitted that the victim's statement was recorded in the aforesaid case under Section 183 of B.N.S.S., wherein, she stated that she had talking terms with co-accused Raja Mandal and on the date of occurrence the petitioner and his daughter sniffed handkerchief and thereafter she found themselves in Delhi where Raja Mandal was present, who is the son of Ravindra Mandal (petitioner) and the entire allegation has been levelled only against Raja Mandal.
It is submitted that the victim actually eloped with Raja Mandal, the son of the petitioner. There is Whatsapp chat and from perusal thereof it would appear that she was in talking terms with Raja Mandal. It is also submitted that prior to the lodging of the present case, Complaint Case No.
3/4 lodged on 07.10.2024 and the present case has been lodged on 15.12.2024. It is further submitted that the petitioner has been made accused only due to the fact that he is father of the main accused Raja Mandal. Lastly, it has been submitted that the petitioner is in custody since 19.12.2024, having one criminal case against him and charge-sheet has been submitted in the case.
5. Learned A.P.P for the State opposes the prayer for bail of the petitioner.

On the other hand, learned counsel for the informant vehemently opposed the prayer for bail of the petitioner and submitted that from perusal of the F.I.R. would show that two witnesses of the F.I.R. have supported the case of the prosecution. It is further submitted that the statement recorded under Section 183 of B.N.S.S. is also against the petitioner.
7. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned
