The petitioner seeks bail in Jhajha P.S. Case No. 97 of 2018 registered for the offence punishable under Sections 394 of the Indian Penal Code and Section 27 of the Arms Act. Informant in his written complaint has stated that on 16.03.2018 at about 5:30 pm he was going to house of his inlaws with his nephew Rajesh Yadav and at about 6:40 pm four unidentified criminals with their faces covered snatched away motorcycle from their possession and fled away. Informant has further stated in his written complaint that from the village sources he could gather information that petitioner and his accomplice are involved in this crime and they also had committed similar nature of crime on the same day.
Patna High Court Cr.Misc. No.46855 of 2018(2) dt.08-08-2018 2/2 It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case due to village rivalry. Petitioner has got no criminal antecedent and is in custody since 17.03.2018.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M. Jamui, in connection with Jhajha P.S. Case No. 97 of 2018.
