The application has been filed alleging violation of the order dated 27.06.2013 passed in C.W.J.C. No. 11840 of 2013. Learned counsel for the petitioner submits that the direction was to remove encroachment from public road which has not been done.
Learned counsel for the State, from the show cause filed on behalf of opposite parties no. 2 to 5, submits that pursuant to action being taken by the authorities for compliance of the order of
Patna High Court MJC No.512 of 2014 dt.14-09-2016 2/2 the Court, notice was served on the opposite party no. 6, but against the same, he has approached the Court in C.W.J.C. No. 13937 of 2014, in which the Court by order dated 02.09.2014 has granted interim stay of the show cause notice dated 12.08.2014 and prohibited the Circle Officer, Narkataiaganj not to take steps pursuant to the said notice. It is further submitted that the petitioner is also respondent in the said writ petition in which notice has been issued. In view of the aforesaid, this Court finds that no contempt has been committed by the opposite parties. Accordingly, the application stands disposed off. The petitioner is at liberty to contest C.W.J.C. No. 13937 of 2014 in accordance with law.
