JUSTICE SANJAY KUMAR ORAL ORDER 24-07-2018 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Kotwali P.S. Case No.209 of 2018 registered for the offences punishable under Sections 418, 419, 420, 120B of the Indian Penal Code and Sections 5, 6 and 9 of the POCSO Act. The informant of this case is a Police Inspector. It is alleged that in the midnight of 05.04.2018 police party conducted raid in three rooms of a hotel and apprehended three F.I.R. named accused with three girls in suspicious condition. It is further alleged that this petitioner used to induce the girls from different places for getting them employed in Patna Municipal Corporation and used to get them involved in immoral act. Patna High Court Cr.Misc. No.38998 of 2018 (3) dt.24-07-2018 lodged with false and frivolous allegation. As per F.I.R., this petitioner was caught with a girl, namely, Sahina Khatoon, who disclosed that she was induced by this petitioner for getting her employed in Patna Municipal Corporation. The other two victims, who were allegedly apprehended, disclosed a different story. The statement of other two victim girls contradicts the statement of victim, who was allegedly found in a room with this petitioner. The other co-accuseds, who were apprehended in different two rooms, have been allowed bail. The petitioner is in custody since 05.04.2018 having clean antecedent and so he deserves to be enlarged on bail.

The learned A.P.P. for the State opposed the submission.

Considering the facts and circumstances of the case, the prayer of bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of the learned Special Judge, POCSO, Patna in connection with Kotwali P.S. Case No.209 of 2018 (Spl. Case No.57 of 2018).
