Mr.Sanjay Kumar Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 05-08-2019 The petitioner apprehends his arrest in connection with Isuapur P. S. Case No. 76 of 2019 registered under Sections 363/366A of the Indian Penal Code.

Allegation against the petitioner is that petitioner along with one Kundan Kumar abducted the daughter of the informant.

Learned counsel appearing on behalf of the petitioner submits that petitioner has not committed any offence in the manner alleged. He further submits that daughter of the informant was recovered and in her statement recorded under Section 164 Cr.P.C. which is Annexure-2 to this application, the victim girl has taken the name of Kundan Kumar and one Lalu whereas name of the petitioner is Mintu Kumar Rai @ Mintu

After having heard learned counsel for the parties and taking into consideration the statement of the girl recorded under Section 164 Cr.P.C., in which she has not disclosed the name of the petitioner as such I am inclined to grant anticipatory bail to the petitioner.

Let the petitioner, above-named, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned SDJM, Chapra (Saran) in connection with Isuapur P.S.Case No. 76 of 2019; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
