The petitioner apprehends his arrest in connection with Turkauliya P.S. Case no. 443 of 2021 registered under sections 307, 384, 387 and other allied section of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R and his name surfaced during course of investigation and as per first information report, there is no specific allegation against the petitioner and there is land dispute between the parties and three persons are stated to have sustained injuries but the said injuries are not

Learned APP opposes the prayer for anticipatory bail. Heard both sides, perused the FIR. Petitioner is not named in the FIR and the prosecution has not drawn attention of the court to any specific role or act in the commission of the alleged occurrence.

Considering these facts, let the above named petitioner, in the event of arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran at Motihari in connection with Turkauliya P.S. Case no. 443 of 2021 subject to condition as laid down under section 438(2) Cr.P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which the matter shall be brought to the notice of this Court.
