JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-07-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 420, 467 and some othr minor Sections of the Indian Penal Code.

As per the prosecution case, this petitioner fraudulently purchased 11 Katha 15 Dhur of land from Sharat Chandra Pandey which was in the share of informant. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. Petitioner is bonafide purchaser of the land and from perusal of the FIR it appears that there is property dispute between the informant and his family and petitioner has nothing to do with the same. Patna High Court CR. MISC. No.61306 of 2021(2) dt.11-07-2022 2/2 consideration money of Rs. 7,04,000/- from the executant and no case u/s 420, 467, 471 of the IPC is made out against the petitioner. Petitioner has got clean antecedent. Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Bagaha, West Champaran in connection with Bagaha (Pathkauli) PS case No. 13/2021, subject to conditions laid down u/s 438(2) of the Cr. P. C.
