Petitioner apprehends his arrest in connection with Jandaha P.S.Case No. 227 of 2015 registered for the offences punishable under Section 392 of the Indian Penal Code. Allegation as per FIR is that three miscreants had come at the petrol pump of the informant and on the point of pistol they looted cash.
Submission of learned counsel for the petitioner is that petitioner is not named in the FIR and later on in confessional statement of co-accused his name transpired and in the confessional statement allegation against the petitioner is that accused persons had stayed in his house and petitioner is liner. Further submission is that on the basis of confessional statement
Patna High Court Cr.Misc. No.47017 of 2018 (2) dt.14-08-2018 2/2 petitioner has been made accused in another case. Heard learned APP also.
Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, named above, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-XI, Vaishali at Hajipur, in connection with Jandaha P.S.Case No. 227 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
