The petitioner apprehends his arrest in connection with Barh P.S.Case No. 10 of 2013 for the offences punishable under Sections 147, 148,149, 323, 325, 341 and 302 of the Indian penal Code and Section 27 of Arms Act.

The informant named the petitioner along with six other accused persons. They having armed with different weapons assaulted her husband Nunu Lal Yadav. The informant along with her father-in-law went at the place of occurrence and saw that accused persons were assaulting her husband by lathi and danda. Ashok Yadav is alleged to have fired causing fire arm injury on the head of Sitaram Yadav and Sulo Yadav is alleged to have fired on the head of her husband.

Patna High Court Cr.Misc. No.4379 of 2015 (2) dt.02-02-2015 2/2 Learned counsel for the petitioner submits that there is no specific allegation against the petitioner. The allegation of firing is against two persons, namely, Ashok Yadav and Sulo Yadav. He further submits that some of the accused persons have already been enlarged on bail.

On perusal of the records it appears that the petitioner came having armed with weapon and assaulted Nunu Lal Yadav. Thereafter accused Ashok Yadav and Sulo Yadav fired killing two persons.

Considering the facts aforesaid, I am not inclined to grant anticipatory bail to the petitioner in Barh P.S.Case No. 10 of 2013.Accordingly, the prayer is rejected.
