JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 419 and 420 of the Indian Penal Code.
It is alleged that in the examination for recruitment of constables, one Chandan Kumar was appearing in place of the petitioner who was apprehended along with the admit card of the petitioner.
It is submitted by learned counsel for the petitioner that Chandan Kumar was appearing without the knowledge of the petitioner and non-grant of bail to the petitioner will jeopardize his career. Moreover, even assuming the accusation, at best, the case under Section 419 IPC is made out.
Considering the aforesaid facts, let the above named
Patna High Court Cr.Misc. No.3590 of 2015 (2) dt.28-01-2015 2/2 petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Nalanda at Biharsharif in connection with Sohsarai P.S. Case No. 145 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. The bail bonds of the petitioner will be accepted by the learned court below on filing affidavit by the petitioner that he will regularly co-operate during investigation. Non-co-operation of the petitioner during investigation will give liberty to the learned court below to cancel the bail bonds of the petitioner. (Dinesh Kumar Singh, J) Amrendra/- U T
