Learned counsel for the petitioner undertakes to remove the defects as pointed out by the office within four weeks of normal functioning of the court, failing which the office is directed to place the matter before the Bench. The petitioner seeks bail in a case registered for the offence punishable under Sections 341, 326, 307, 504, 34 of the Indian Penal Code and 27 of the Arms Act.
Allegation against the petitioner along with other accused persons is said to have assaulted the informant and his family members by lathi-danda, pharsha and also caused injury by firearm.
Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.9335 of 2021(2) dt.06-07-2021 2/2 petitioner is innocent and has falsely been implicated in this case. He further submits that there is land dispute between the parties and there is case and counter case between the parties. The petitioner is languishing in judicial custody since 30.09.2020. The petitioner has got 02 criminal antecedents which is mentioned in para 3 of the bail petition. Learned counsel for the informant and APP for the State opposed the prayer for bail and submits that the injury report is grievous in nature.
Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail after completion of one year custody, on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each in connection with Madhepur P.S. Case No. 66/2020, G.R. No.590/2020 to the satisfaction of learned Court below where the case is pending.
