2. The present writ application has been filed for setting aside the order dated 16.03.2024 passed by the District Magistrate, Patna-cum-Second Appellate Tribunal in Complaint No. 528618007102300384/2A and the impugned order passed under Release No. 42811-41445 vide impugned order dated 16.03.2024.
3. At the very outset, learned counsel for the State Pollution Control Board has produced a copy of the order dated
Patna High Court CWJC No.13355 of 2025(2) dt.30-10-2025 2/3 21.01.2025 passed in CWJC No. 9627 of 2024 and has submitted that an earlier writ was filed for the same relief which was permitted to be withdrawn.
4. Upon perusal of the order dated 21.01.2025 passed in CWJC No. 9627 of 2024 it is clear that the same has been permitted to be withdrawn but there is no mention about the same in this writ application and the order dated 21.01.2025 reads as under:- Heard the learned counsel for the petitioner, Mr. Kumar Ravish, the learned counsel appearing on behalf of Bihar State Pollution Control Board, Patna and the learned counsel appearing on behalf of the State.
2. After some arguments, the learned counsel for the petitioner seeks permissions to withdraw the present application.
3. Permission, as prayed for, is accorded.
4. Accordingly, the present writ petition stands dismissed as withdrawn.
5. From the above, it appears that the fact of withdrawal of the CWJC No. 9627 of 2024 has been suppressed by the petitioner and the present writ application has been filed for obtaining a favourable order from this Court.
6. In these circumstances, this application is dismissed
Patna High Court CWJC No.13355 of 2025(2) dt.30-10-2025 3/3 with a cost of Rs. 5000/- which shall be deposited by the petitioner in the Patna High Court Legal Services Authority within two weeks from today.
7. Henceforth, the office, while doing stamp reporting in such matter, will do it properly so that this kind of frivolous writ application is not filed by the petitioner in this Court. (Sandeep Kumar, J) Vikas/- U
