The petitioner has preferred this application for grant of regular bail in a case registered under sections 307, 323, 341, 353 and 34 of the Indian Penal Code.

As per the prosecution case, the petitioner is said to have thrown a brick on the informant, a police personnel, causing injuries on his head.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No reason has been assigned in the F.I.R. for the petitioner to have committed such an occurrence. The petitioner is in custody since 24.6.2021 and chargesheet has been submitted in the case. He has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner having remained in custody for more than 9 months and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Town P.S. Case no.130 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur.
