The prayer for anticipatory bail of the petitioner was earlier rejected by this Court vide order dated 8.11.17 passed in Cr. Misc. No.51680 of 2017.

This is the second anticipatory bail application filed on behalf of the petitioner on the sole ground that petitioner has been declared juvenile by the order dated 01.02.2018 passed by Additional Sessions Judge 1st-cum Special Judge POCSO Act, Begusarai. This Court , is of the view that the order dated 1.2. 2018 has been passed after taking into consideration the merit of the case. This Court does not find any merit in this second anticipatory bail application.

Prayer for anticipatory bail stands again rejected. Petitioner may surrender before the Court below and

Patna High Court Cr.Misc. No.48676 of 2018(2) dt.08-08-2018 2/2 make prayer for regular bail which shall be considered and disposed of, if possible on the same day, on its own merit in accordance with law without being prejudiced by the present order.
