Heard learned counsel for the petitioner and learned A.P.P for the State.
The petitioner seeks bail in Natwar P.S. Case No. 58 of 2020 (POCSO Case No. 62 of 2020), registered for the offence punishable under Sections 363, 366A of the Indian Penal Code.
As per the prosecution case, this petitioner abducted the daughter of informant for solemnizing marriage. It is submitted on behalf of the petitioner that no offence as levelled against this petitioner has been made out and no averment has been made regarding sexual assault. Only on the basis of suspicion he has been made accused in this case.
Patna High Court CR. MISC. No.9565 of 2021(3) dt.31-08-2021 2/2 Chargesheet has already been submitted and there is no chance of tampering with the evidence. Petitioner is in custody since 31.07.2020 having no criminal antecedent.
Learned APP however, vehemently opposed the prayer for bail and submitted that Considering the facts aforesaid and the statement of victim girl under Section 164 Cr.P.C, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.
