JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-09-2017 Heard learned counsel for the petitioner as well as learned counsel appearing for the University. It would appear from perusal of this petition that the Joint Transfer Committee decided to issue transfer order to several persons including Dr.M.M.Mishra vide memo no. L.N.M.U/DRII/01/1856-67/16 dated 10.02.2016 which is annexed as Annexure5 to this petition. The aforesaid order was served upon the petitioner on 11.02.2016 but the petitioner made a noting on the peon's book that he is not Dr. M.M.Mishra and, thereafter, petitioner made a representation to Principal C.M.Science College, Darbhanga regarding the above stated controversy. However, when nothing was done, petitioner filed this writ petition and in

Patna High Court CWJC No.11713 of 2016 (3) dt.05-09-2017 2/2 the meantime, the University issued a corrigendum again mentioning the name of one Sri. M.M.Mishra though the aforesaid corrigendum was never served upon the petitioner. However, it is informed on behalf of the petitioner that subsequently, the University by subsequent order made certain changes in the aforesaid previous order of Joint Transfer Committee.

In view of the aforesaid submissions, this petition stands disposed of giving liberty to the petitioner to file fresh representation before the respondent no. 3 raising his grievances within two weeks and, if petitioner does so, the respondent no. 3 shall pass appropriate order on the representation of the petitioner within six weeks from the date of its filing.
