Patna High Court CR. MISC. No.8519 of 2021(4) dt.21-02-2022 2/3 of petitioner nos.2, 4 and 10 was withdrawn.
Accordingly, today the instant case is being heard for consideration of anticipatory bail on behalf of rest of the petitioners.
Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 332, 333, 307, 337, 338, 353, 504, 506, 224, 225, 427 of the Indian Penal Code.
Allegation against the petitioners is that they assaulted the police party with lathi, danda, stone and weapons in order to rescue one accused namely Rampukar Mandal.
It is submitted by learned counsel for the petitioners that petitioners are innocent and have been falsely implicated in this case. He submits that there is general and omnibus allegation levelled against all the petitioners. He submits that petitioners are members of mob. He further submits that petitioners have no criminal antecedent as stated in para-3 of this application and several similarly situated co-accused have been granted anticipatory bail vide order dated 06.01.2022 passed in Cr. Misc. 13841 of 2021.
Patna High Court CR. MISC. No.8519 of 2021(4) dt.21-02-2022 3/3 Learned APP for the State opposed the prayer for bail. Considering the facts and circumstances of the case and also fact that there is general and omnibus allegation levelled against the petitioners, the above named petitioners except petitioner nos.2, 4 and 10, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Gogri P.S. Case No. 316 of 2020, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Anjani Kumar Sharan, J) pallavi/- U T
