The petitioners apprehend their arrest in K.Hat (Maranga) P.S. Case No. 792 of 2014, registered for the offences punishable under Sections 302/201/34 of the Indian Penal Code. Informant Priti Devi, the mother of Shivraj Kumar @ Raju lodged a case that her son was living in a hostel run by the petitioners but his son is traceless. She suspected that the petitioners might have killed her son.

Learned counsel for the petitioners submits that the victim boy has returned and made his statement under Section 164 Cr.P.C. He disclosed that he fled away from the school as the petitioners were torturing him making allegation of theft.

No.4029 of 2015 (2) dt.29-01-2015 2 / 2 Having considered the facts that the boy has already returned and he made statement under Section 164 Cr.P.C., petitioners Bandana Devi and Sujit Kumar @ Sujeet Kumar, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in connection with K.Hat (Maranga) P.S. Case No. 792 of 2014, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
