2. The petitioner seeks a direction upon the respondents to remove the encroachment from his Raiyati land, over which Mukhiya of Singhara Panchayat under Maner Block

Patna High Court CWJC No.11501 of 2024(2) dt.05-08-2024 2/3 has constructed a road from government fund without there being any intimation or consent of the petitioner; and without initiation of any acquisition proceeding or compensation thereof.

3. Learned Advocate for the petitioner contended that the construction of the road over the land in question has been done behind the back of the petitioner as he had been working in different place as a government servant holding the post of Circle Officer. On being superannuated on 31.01.2024 when he came to his village, he found that a road has already been constructed over his Raiyati land. For redressal of his grievance the petitioner also approached before the Sub-Divisional Public Grievance Redressal Officer, Danapur, but till date no action has been taken. Representation has also been filed before the District Magistrate, Patna and other authorities but nothing has been done.

4. Considering the limited grievance of the petitioner, the District Magistrate, Patna is directed to consider the representation of the petitioner and after getting a report from the concerned Circle Officer, Maner Anchal and after giving proper opportunity of hearing to other stakeholders, if need be, dispose off the same by a reasoned and speaking order

5. The writ petition stands disposed off.
