2. This is the first anticipatory bail application preferred by the petitioner who apprehend his arrest in connection with Turkauliya P.S. Case No. 131 of 2021 registered for the offences punishable under Sections 323, 341, 379, 354, 504, 506, 307 and 34 of the Indian Penal Code.

According to the case of prosecution, it is alleged that on 11.02.2021 at about 10:00 A.M. when the informant Rima Devi was in her residence at that time a dispute took place between the son of the informant Kundan Kumar and father of the present applicant Raghunath Singh. The present applicant came there and assaulted Kundan Kumar with the help of an

No.50214 of 2025(2) dt.12-08-2025 2/3 iron rod due to that Kundan sustained injury on his head, when the informant went to save her son the present applicant and Chandeshwar Singh also assaulted Rima Devi. It is further alleged that the co-accused Abha Devi snatched one golden chain from the neck of the informant Rima Devi. On the basis of the written complaint made by Rima Devi offences has been registered.

4. Learned counsel for the petitioner submits that the petitioner is innocent and is falsely implicated in this case due to family dispute between both the families. He further submits that only one injury has been found on the head of injured Kundan Kumar. According to the counsel for re-examination of the injury an application has been submitted by the petitioner before the Medical Board but till today the victim has not turned up before the Medical Board. Therefore, he prays that on these grounds, he may be granted benefit of anticipatory bail.

5. Learned APP for the State opposes the prayer for anticipatory bail.

6. Considering the submissions made by the counsels and particularly considering the fact that the incident is of year 2021 and still the petitioner has not been arrested meaning thereby he is absonding from the last four years further

Patna High Court CR. MISC. No.50214 of 2025(2) dt.12-08-2025 3/3 considering the fact that the injured person has sustained injury on the vital part of his body i.e. head, I am not inclined to grant the benefit of anticipatory bail to the petitioner. Accordingly, the bail application is rejected.
