The State of Bihar .... .... Opposite Party/s ====================================================== CORAM: HONOURABLE MR. JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-01-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

Petitioners apprehend their arrest in connection with Sikandra P.S. Case No. 233 of 2013 registered for the offence under Sections-302, 498A/34 of the Indian Penal Code. Petitioners are in-laws of the deceased. Originally, the case was registered under Sections-304(B)/34 of the Indian Penal Code but after completion of investigation, police submitted charge sheet u/S 302, 498A of the Indian Penal Code against husband of the deceased and so far as petitioners are concerned; insufficient evidence was found against them and accordingly, they were not sent up for trial but the learned Magistrate differed with the findings of the police and took cognizance against petitioners also.

Considering the above-said facts and circumstances as

Patna High Court Cr.Misc. No.3476 of 2015 (2) dt.27-01-2015 well as submission of the parties, let the petitioners named above, in the event of their arrest or surrender within four weeks from the date of receipt/production of copy of order in the court below, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Sikandra P.S. Case No. 233 of 2013 to the satisfaction of Sri Raghuvansh Narayan, Judicial Magistrate-Ist Class, Jamui subject to conditions as laid down u/S 438(2) of the Cr. P.C.
