It is contended on behalf of the petitioner that, at the behest of the Public Works Department, displaced persons have constructed their hutments near the boundary wall of his plots mentioned in this writ application obstructing the right of easement of the petitioner. Constructions are unauthorized and, as such, they are required to be removed. He had moved before all the authorities including the District Magistrate, Patna by filing his
Patna High Court CWJC No.12255 of 2014 (2) dt.22-01-2016 2/2 representation which appears to have been received by his office on 26.03.2014.
Having regard to the aforementioned facts and circumstances, this writ application is being disposed of with a direction to the District Magistrate, Patna to enquire into the matter and take a decision in accordance with law on the representation filed by the petitioner within a period of three months from the date of receipt/production of a copy of this order.
