The petitioner apprehends his arrest in connection with Begusarai Town P.S. Case No. 376 of 2020 registered under Sections 420/120(B) of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Petitioner has no concern with the seized wine or seized vehicle. Further he contended that on perusal of seizure list, it appears that nothing has been recovered from the possession of the petitioner.

Having considered the facts and circumstances of the

No.7646 of 2021(2) dt.22-10-2021 2/2 case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the A.D.J.-2nd-cum-Special Judge, Excise Act, Begusarai in connection with Begusarai Town P.S. Case No. 376 of 2020, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
