2. Learned Counsel for the petitioner submits that the petitioner is aggrieved with the impugned order dated 02.06.2026 passed by the Respondent No. 6. Learned Counsel for the petitioner further submits that earlier benefit of ACP/MACP and the other benefits which have been granted to

3. Learned Counsel for the State submits that filing counter affidavit in this case is necessary.

4. It transpires to this Court that Annexure P/13 is the order dated 02.06.2026 which is impuged herein has admittedly been passed without granting any opportunity to the petitioner.

5. In the aforesaid background, the petitioner is directed to file a fresh representation raising all his grievances as raised in the present writ petition before respondent No.2, namely, The Principal Secretary, Finance Department, Government of Bihar, Patna, along with a copy of this order, within 30 days from today. Upon receipt of the representation, the Respondent No.2, namely, The Principal Secretary, Finance Department, Government of Bihar, Patna, is directed to take a decision on the said representation within 90 days from the date of its filing, with a reasoned and speaking order after awarding opportunity of hearing to the petitioner either himself or through an advocate.

6. Till taking final decision on the representation of the petitioner, the impugned order dated 02.06.2026 contained

Patna High Court CWJC No.10893 of 2026 dt.27-07-2026 3/3 in Memo No. 833 issued by the Respondent No. 6 namely the Chief Engineer, Water Resources Department, Central Design Research and Quality Control, Anishabad, Patna (AnnexureP/13) to the writ petition shall remain inoperative with respect to the petitioner only.

7. With the aforesaid observation and direction, the writ petition stands disposed off.
