The petitioner apprehends his arrest in Bithan P.S. Case No. 23 of 2011, registered for the offences punishable under Sections 147, 148, 149, 307, 341, 553, 171(C), 171(F) and 427 of the Indian Penal Code, Section 27 of the Arms Act as well as Section 135(A) of the Representative of People Act. The Presiding Officer of Booth No. 16, situated in Primary School, Bhuidhar, named many persons and alleged that the named accused and others having armed with different weapons came and snatched ballot papers. They also opened fire. Learned counsel for the petitioner submits that the petitioner is not named in the First Information Report. No specific allegation is made against the petitioner. Name of the

Having considered the facts that the petitioner is not named in the First Information Report and no specific allegation is made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rosera, Samastipur in connection with Bithan P.S. Case No. 23 of 2011, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
