The petitioners apprehend their arrest in Complaint Case No. 1200C of 2013, registered for the offences punishable under Section 406 and other Sections of the Indian Penal Code. The complainant alleged that the petitioner no. 1 Maksood Alam @ Maqusood borrowed Rs. 40,000/- from him for construction of his house, but on demand the petitioners are alleged to have threatened the complainant and also assaulted him with fists and slaps.
On perusal of record, it appears that the dispute arose on account of borrowing and lending money. No chit of papers is
Patna High Court Cr.Misc. No.3709 of 2015 (2) dt.28-01-2015 filed to show that the petitioner ever borrowed any money from the complainant.
Considering the facts aforesaid, the petitioners, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Munger in connection with Complaint Case No. 1200C of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
