Heard learned counsel for the petitioner, learned Addl. Public Prosecutor for the State as well as learned counsel for the informant.

Petitioner apprehends his arrest in connection with Kotwali P. S. case no. 636/2014 registered under sections 302, 307, 120B and other allied sections of the IPC.

Petitioner is named in the first information report but only allegation of conspiracy has been levelled against him and according to the prosecution case itself, petitioner had not taken active part in the commission of murder of deceased. It further appears that there was land dispute between the parties for which brother of the petitioner lodged Kotwali P. S. case no. 105/2014.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of arrest/ surrender within four

No.3928 of 2015 (2) dt.29-01-2015 weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in Kotwali P. S. case no. 636/2014 subject to condition as laid down under section 438(2) of the Cr.P.C.
