This is a petition for grant of regular bail in connection with Nawadah (Town) P.S. Case No. 196 of 2017 for offences under Sections 147, 148, 149, 341, 323, 307, 353, 188, 283, 337, 427, 435 and 153(a) of the Indian Penal Code. Allegation, in brief, is that on account of some communal disturbance members of both the religious community gathered and pelted stones to each other and also pelted stones over the police personnel, who h ad gone there to maintain law and order.

Learned counsel for the petitioner submits that 30 persons are named in the first information report along with 1300 unknown persons and int eh first information report there

Patna High Court Cr.Misc. No.47265 of 2018(2) dt.02-08-2018 2/2 is only written statement that 18 persons are mentioned which does not included the name of the petitioner. Later on the name of the petitioner was also included. However, there is no any specific accusation against him and in fact he was a passer-bye and has been made accused.

Having considered the aforesaid facts and circumstances, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Nawadah (Town) P.S. Case No. 196 of 2017 to the satisfaction of the Chief Judicial Magistrate, Nawadah. (Arun Kumar, J) ShamshadSaurabh/- U T
