2. The petitioner apprehends his arrest in connection with Muffasil P.S. Case No. 120 of 2023 registered for the offences punishable under Sections 341, 323, 325, 379, 448, 354, 307, 504, 506/34 of the Indian Penal Code.

3. As per prosecution case, when the informant was with her children at her house, the accused persons including the petitioner came there and assaulted her and her daughter. The allegation against the petitioner is that he assaulted the informant with farathi.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case due to land dispute. There is general and omnibus

Patna High Court CR. MISC. No. 54398 of 2024(3) dt.26-10-2024 2/3 allegation of assault with farathi against the petitioner. The informant and her daughter did not receive injury from the petitioner. He further submits that the injuries found on the person injured are simple in nature. He also submits that similarly situated co-accused namely Jitendra Ravidas @ Jitendra Das and Sambhu Ravidas @ Sambhu Das have already been granted anticipatory bail vide order dated 09.08.2023 passed in ABP No. 1779 of 2023. Petitioner has no criminal antecedent and he undertakes to cooperate in the investigation and trial of the present case.

5. Learned APP opposes the prayer for anticipatory bail of the petitioner.

6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the concerned Court where the case is pending in connection with Muffasil P.S. Case No. 120 of 2023, subject to the conditions as laid down under Section
