JUSTICE AMARESH KUMAR LAL ORAL ORDER 11-02-2015 This application has been filed for modification of the order dated 15.09.2014 passed in Cr. Misc. No.25616/2014 by which the petitioners were directed to surrender within four weeks before the learned Chief Judicial Magistrate, Jehanabad in Ghoshi P.S. Case No. 140/2001.

It is submitted that the petitioner no.1 had to join the post of Librarian and the petitioner no.2 was not informed by the petitioner no.1 regarding the period of surrender, as such, they could not surrender within the time granted by the Court.

The ground for modification of the order does not appear to be sound. However, in the interest of justice, the order dated 15.09.2014 passed in Cr. Misc. No.25616/2014 is modified to the extent that the petitioners will surrender by 28.02.2015 subject to condition that they will deposit a cost of Rs.1000/-in favour of Patna

Patna High Court Cr.Misc. No.4989 of 2015 (2) dt.11-02-2015 2/2 High Court Legal Services Committee and file a receipt thereof by 18.02.2015.

Accordingly, this application is allowed to the extent indicated above.
