This Criminal Appeal has been preferred against order dated 24.05.2018 passed by 1st Additional Sessions Judgecum-Special Judge, Saharsa, in Sessions Trial No. 274 of 2015 arising out of Salkhua P. S. Case No. 55 of 2015 by which and whereunder, he rejected the bail prayer of the appellant. Submission on behalf of the appellants is that in course of trial, not a single prosecution witnesses stated about the involvement of the appellants in the alleged crime but he frankly admitted that prosecution case has already been closed and presently, the case is pending in the vacant court for argument. Since the trial of the appellants is on the verge of
Patna High Court CR. APP (SJ) No.2585 of 2018 (3) dt.25-07-2018 2/2 conclusion and, therefore, I am not inclined to release them on bail hence, their prayer for bail in connection with Sessions Trial No. 274 of 2015 stands rejected, as a result whereof, this appeal stands dismissed on admission stage itself.
However, the learned Sessions Judge, Saharsa shall ensure that the Sessions Trial No. 274 of 2015 shall be disposed of within two months from the date of receipt/production of a copy of this order.
