Sessions Judge-III-cum-Special Judge, CBI-II, Patna vide letter no. 34 dated 31.01.2019 reported that in spite of his best effort up till now, only three proposed witnesses could be examined. It has also been mentioned in the aforesaid letter that as per direction of the High Court, the CBI court has to give first priority to conduct the trial of CBI cases. Moreover, Learned Addl. Sessions Judge has sought nine months' further time for conclusion of Special case no. 38 of 2014 arising out of Economic Offence P.S. Case No. 24 of 2014.

In view of the aforesaid letter, further nine months' time is granted to learned Addl. Sessions Judge-III-cum-Special

Patna High Court Cr.Misc. No.30325 of 2018(4) dt.20-02-2019 2/2 Judge, CBI-II, Patna for conclusion of above stated Special case no. 38 of 2014. However, Learned Addl. Sessions Judge-IIIcum-Special Judge, CBI-II, Patna must take effective steps for conclusion of trial of above stated Special case no. 38 of 2014 within the period as sought for by the learned trial court itself. Let a copy of this order be sent to S.P., Economic Offences, Unit, Patna with direction to him to ensure the presence of prosecution witnesses before learned Addl. Sessions Judge-III-cum-Special Judge, CBI-II, Patna in connection with Special case no. 38 of 2014 within three months. Failure on the part of S.P., Economic Offences, Unit Patna shall be viewed seriously.
