The petitioner seeks bail in Bariarpur P.S. Case No. 36/2018, instituted for offence under Section(s) 302, 120(B)/34 of the Indian Penal Code read with Section 27 of Arms Act. Learned counsel for the petitioner has submitted that there is specific allegation against Raushan Kumar and Ritesh Kumar of firing on the husband of informant on his head and abdomen on account of which he died on the spot. Informant has levelled general and omnibus allegation against this petitioner in the written report that this petitioner had conspired in killing the husband of informant.

Police has submitted final form against the petitioner. The learned A.C.J.M. IInd, Munger after differing with the final

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Munger, in connection with Bariarpur P.S. Case No. 36/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
