JUSTICE SUDHIR SINGH ORAL ORDER 14-05-2015 The petitioner is apprehending his arrest in connection with Deo P.S.Case No. 89/2014 instituted under Section 409/34 of the Indian Penal Code and Section 7 E.C.Act. Heard learned counsel for the petitioner and the State. The allegation against the petitioner is of selling the food grains in black market.

It has been submitted on behalf of the petitioner that the petitioner is a P.DS. dealer and at the time of occurrence he was a licence holder. It has further been submitted that recovery of food-grain is said to have been made from the possession of one Santosh Kumar and no such recover has been made from the possession of the petitioner. It is submitted on behalf of the petitioner that the petitioner is ready

Patna High Court Cr.Misc. No.3795 of 2015 (3) dt.14-05-2015 2/2 to deposit an amount of Rs. 8,000/-, which shall be subject to final disposal of the case.

Learned counsel for the State ahs submitted that the petitioner is named in the FIR.

Considering the fact that the petitioner is ready to deposit an amount of Rs. 8000/- in the court below , which shall be subject to disposal of the case, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of five weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad in connection with Deo P.S.Case No. 89/2014, subject to the conditions as laid down u/s 438(2) Cr.P.C.
