JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-08-2019 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 307, 379, 427 and 354/34 of the IPC.

The prosecution case is that the FIR named accused persons including the petitioners damaged the centering, the part of the construction of the informant's house and on protest being made, they entered into the house of the informant and made assault, as a result the husband of the informant received fracture injury on his hand.

It is submitted by learned counsel for the petitioners that

No.48094 of 2019(2) dt.02-08-2019 2/2 the petitioners are the agnates of the informant and in the background of dispute with regard to construction, the accusation has been levelled. It is further submitted that the accusation of assault is omnibus and general against all the accused persons including the petitioners. A statement has been made in paragraph no.3 that petitioner no.1 is accused in other case, in which he is on bail, whereas petitioner nos. 2 and 3 are not having any criminal antecedent.

Learned APP submits that the petitioners are named in the FIR with specific accusation.

Considering the nature of accusation being omnibus and general, let the above named petitioners be released on anticipatory bail in the event of arrest/surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Muffasil P.S. Case No. 250 of 2019, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
