NATH ORAL JUDGMENT Date: 17-10-2016 Heard Mr. Jha, learned counsel for the petitioner and also the learned counsel appearing on behalf of the respondents. The petitioner is aggrieved by the impugned order by which the learned court below has refused to mark the certified copy (Ext. 1) as exhibit at the appellate stage. From the submissions as well as from the impugned order, it transpires that the sale deed was produced by the petitioner in the learned court below and was marked as Ext. 1 in the suit. However, after the decision of the suit, the said sale deed was taken back. Subsequently, at the appellate stage the petition was filed by the petitioner for marking the certified copy of the said sale deed (Ext. 1) as exhibit on the ground that the sale deed (Ext. 1) had been lost. The appellate court below has turned down the
Patna High Court CWJC No.13515 of 2014 dt.17-10-2016 prayer of the petitioner but has further marked the certified copy of the said sale deed for identification as 'X' for just decision. After considering the submissions, this Court does not find that the impugned order requires interference under Article 227 of the Constitution of India. The application is accordingly, dismissed.
