1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 105, 3(5) of the B.N.S.S.

3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and petitioner no.1 is a woman and the informant alleges that on 21.12.2024, her husband Nandlal and Nandoshi Rajkumar were quarreling in an inebriated condition, further during quarrel, her daughter, who was sleeping came under the feet of Rajkumar and died, further when she started crying, her father-in-law, mother-in-law along with other family members came and assaulted her, next alleges that since a daughter was born hence the accused persons used to torture her.

4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that Nandlal and Rajkumar are in custody. It is further submitted that petitioners are mother-in-law and father-in-law of the informant. It is also submitted that allegation that the child died as she came under the feet of Rajkumar. It is submitted that the entire family members were in a state of shock when the occurrence took place.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

6. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned trial court where the case is pending/successor court in connection with Amarpur P.S. Case No.820/2024, subject to the conditions as laid down under Section 482(2) of the B.N.S.S.
