JUSTICE SANDEEP KUMAR ORAL ORDER 06-12-2021 At the very outset, learned counsel for the petitioners seeks permission to withdraw the present anticipatory bail application as against petitioners No. 1 (Chhatu Ram), Petitioner No. 3 (Osiyar Ram) and Petitioner No. 5 (Niraj Ram @ Niraj Kumar Ram) as they have been arrested and the application has become infructuous.
Permitted to be withdrawn.
It is, thus, dismissed as withdrawn as against petitioners No. 1, 3 and 5.
Patna High Court CR. MISC. No.8087 of 2021(2) dt.06-12-2021 2/2 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners apprehend their arrest in connection with Natwar P.S. Case No. 55/2020 registered for the offences punishable under Sections 147/148/149/341/323/307/504/506 of the Indian Penal Code.
So far as petitioner No. 2, 4 and 6 are concerned, there is general and omnibus allegation against them. Considering the fact that the occurrence took place on account of land dispute, the present anticipatory bail application is allowed.
Accordingly, let the petitioners above named be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Rohtas, in connection with Natwar P.S. Case No. 55/2020, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
