It appears that Cr. Misc. No. 14556 of 2016 arose out of G.R.P. Biharsharif P.S. Case No. 01 of 2016 registered under Sections 399, 402 and 307 of the Indian Penal Code and under Sections 25(1-B)A, 26, 35 and 27 of the Arms Act and Cr. Misc. No. 21162 of 2016 arose out of Mokama R.P.F. P.S. Case No. 1 of 2016 registered under Section 3 of the R.P. (U.P.) Act and both the cases does not relates with the present case. Heard both sides.
The petitioner apprehends his arrest in Rail Patliputra P.S. Case No. 1 of 2016, registered for the offences punishable
Patna High Court Cr.Misc. No.23443 of 2016 (4) dt.03-08-2016 2/2 under Section 374 of the Indian Penal Code and under Section 26 of the J.J. Act.
The labour superintendent alleged in his statement that Mantu Chaudhary was apprehended with seven children whom Mantu Chaudhary was taken to Pune. Mantu Chaudhary disclosed that Upendra Yadav handed over the children to take them to Pune where Dinesh Yadav brother of Upendra Yadav was residing. It is submitted that the petitioner was not present at the place of occurrence. On the statement of Mantu Chaudhary name of the petitioner figured in the case.
Considering the facts aforesaid, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Shri Sanjay Kumar, Rail Judicial Magistrate 1st Class, Patna in Rail Patliputra P.S. Case No. 1 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
