This application for anticipatory bail arises out of Maner P.S. Case No. 544 of 2017 for the offence punishable under Section 302/34 of the Indian Penal Code. The wife of the deceased is the informant and it appears that father, mother, brother and sister of deceased have been implicated in the First Information Report. Learned counsel appearing on behalf of the petitioner has submitted that with similar allegation, father, mother and brother of the petitioner, have been allowed anticipatory bail by separate orders, which have been brought on record by way of Annexure-3, 3/A and 3/B of this application. Considering the fact that similarly circumstanced co-accused persons have been allowed anticipatory bail, this application is allowed.

No.50539 of 2019(2) dt.14-08-2019 2/2 Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Danapur, Patna, in Maner P.S. Case No. 544 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
