JUSTICE ASHUTOSH KUMAR ORAL ORDER 27-08-2019 The petitioner seeks a direction to the respondent authorities for re-inducting the petitioner on the post of Sweeper on which he was appointed on compassionate ground in the event of death of his father in harness.

The petitioner worked for about ten years whereafter he absented himself from the duties. Way back in the year 2003, a notice was issued to him to immediately get his presence marked or else he would be deemed to have been removed from service. After about two years of the aforesaid notice, the petitioner filed an application intimating the concerned respondent

Patna High Court CWJC No.16607 of 2019(2) dt.27-08-2019 2/2 that he had been suffering from mental illness and therefore he could not appear in response to the aforesaid notice.

The medical prescriptions which have been annexed with the writ petition completely belies the correctness of the aforesaid statement.

From 2001, the petitioner has not been presenting himself in the department for doing his work. From the averments made in the writ petition, it appears that the petitioner had abandoned his job.

No good ground has been made out by the learned counsel for the petitioner for passing any order in favour of the petitioner directing the respondents to induct him in service again.

The petition is dismissed.
