Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defect(s) as pointed out by the office when called upon to do so by the office. The petitioner is apprehending his arrest in connection with Chainpur P.S. Case No. 118 of 2020 registered for the offences punishable under Sections 304-B/34 of the Indian Penal Code, which is pending before CJM, Kaimur at Bhabua. Prosecution case relates to dowry death against the petitioner and in-laws due to non-fulfilment of dowry demand, i.e. golden chain.

It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.7663 of 2021(3) dt.13-01-2022 2/2 that the petitioner has falsely been implicated in this case. He further submits that the deceased was ill tempered lady, as such she committed suicide.

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

From perusal of the case diary, it appears that the witnesses have supported the prosecution case . The petitioner is husband of the deceased and he is wholly responsible towards his wife, i.e., deceased, namely, Nitu Kumari. Postmortem report also shows that the cause of death of the deceased is due to asphyxia by hanging, as such, it is not a fit case for grant of anticipatory bail. Prayer for anticipatory bail is rejected. (Sunil Kumar Panwar, J) brajesh kumar/- U T
