The petitioner, already in custody, seeks bail in connection with Begusarai Town P.S.Case No. 251 of 2018 registered under Sections 419, 420, 504 and 506/34 of the Indian penal Code.
Allegation in brief is that petitioner promised to get a land adjacent to the house of the informant executed in his favour by the landlord concerned and Rs. 2,00,000/- was given to the petitioner and Rs. 1,00,000/- was spent on construction of boundary wall but the sale deed was not executed. Submission is that petitioner was only mediator in between the informant and the landlord and he incurred Rs. 1,00,000/- on construction of boundary wall without getting the sale deed executed and later on, landlord retracted, even there
Patna High Court Cr.Misc. No.45594 of 2018(2) dt.31-07-2018 2/2 was no agreement for sale in between the informant and the landlord.
Having considered the aforesaid facts and circumstances, as the dispute primarily appears civil in nature, so the petitioner, namely , Sajan Yadav, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Begusarai in connection with Begusarai Town P.S.
