JUSTICE ARUN KUMAR ORAL ORDER 07-08-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 31.3.2018, seeks bail in Khusrupur PS Case No. 48 of 2018 registered under Sections 363 and 366A of the IPC.

The accusation is that the petitioner, a married man with the elder cousin sister of the girl, enticed her away and committed rape; the victim girl in her statement recorded under Section 164 Cr.P.C. stated that duping her the petitioner taken her somewhere else and committed rape in captivity.

The learned Counsel submits that present case was lodged after delay of ten days and has been falsely implicated due to family dispute.

Whereas learned APP submits that the girl is minor only 16 years of age and petitioner, a married man, enticed her away and committed rape.

Having considered the aforesaid facts and circumstances, presently the prayer for bail of the petitioner is rejected. Snkumar/- (Arun Kumar, J) U T
